REGULATION ON INTERNATIONAL LAW AND HUMAN RIGHTS APPLICATION AND RESEARCH CENTER

 

 

PART ONE

Purpose, Scope, Basis and Definitions

 

 

Objective

 

ARTICLE 1 - (1)The purpose of this Regulation is to regulate the provisions regarding the establishment, objectives, fields of activity, duties of the governing bodies and working style of Ibn Haldun University International Law and Human Rights Application and Research Center.

 

Scope

 

ARTICLE 2 - (1) This Regulation covers the provisions regarding the aims, fields of activity, duties of the governing bodies and working style of Ibn Haldun University International Law and Human Rights Application and Research Center.

 

Basis

 

ARTICLE 3 - (1) This Regulation has been prepared based on subparagraph (2) of subparagraph (d) of the first paragraph (d) of Article 7 and Article 14 of the Higher Education Law No. 2547 dated 4/11/1981.

 

Definitions

 

Article 4 - (1) In this Regulation;

 

a) Advisory Board: Advisory Board of the Center,

b) Center: International Law and Human Rights Application and Research Center,

c) Director: The Director of the Center,

ç) Rector: Rector of Ibn Haldun University,

 

e) Board of Directors: The Board of Directors of the Center,

refers to.

 

 

 

SECTION TWO

Purpose and Fields of Activity of the Center

Purpose of the Center

 

Article 5 - (1) The objectives of the Center are as follows

 

a) To carry out all kinds of scientific, theoretical and practical research and studies in the fields of international law and human rights law and to carry out all kinds of activities, including consultancy, for the development and establishment of methods for the settlement of disputes and the maturation and spread of public awareness in this field.

b) To conduct studies on international law and human rights law in cooperation with national and international organizations.

c) To develop international law and human rights law, to provide education and training for those working in these fields in order to provide them with the necessary knowledge and skills, and to open certificate programs.

ç) To cooperate with public and private institutions in the fields of international law and human rights law and to provide consultancy to these institutions when necessary, to undertake research for this purpose and to assist researchers.

 

Areas of activity of the Center

 

ARTICLE 6 - (1) The fields of activity of the Center are as follows:

 

a) Conducting researches and publications, preparing reports and conducting projects in the field of international law and human rights law, or commissioning, participating in or supporting such studies.

b) To organize and have organized all kinds of scientific, artistic and cultural activities such as conferences, seminars, panels, panels, congresses, symposiums, shuras and similar scientific, artistic and cultural events at national and international level on international law and human rights law.

c) To cooperate with public, private and foundation schools and non-governmental organizations on international law and human rights law. To develop cooperation opportunities with the relevant departments and institutes of universities within the framework of the subject.

ç) To select and reward examples of scientific studies conducted in the field of international law and human rights law, and to organize activities such as competitions, award ceremonies, etc.

 

d) To cooperate and collaborate with universities, centers and organizations working on international law and human rights law.

e) To organize and support activities with scientific content such as study and search meetings, panels, conferences, workshops, domestic or international symposiums, etc., provided that they are oriented towards the field of study of the Center; to share the results and products with stakeholders in visual, printed or electronic media.

f) To carry out joint activities with the units and all application and research centers within the University; to carry out joint activities and cooperation with the press and media organs in line with the objectives of the center, to organize sharing and promotional meetings.

g) To employ sufficient number of personnel with the necessary qualifications to carry out the activities of the Center, to establish working units and working and project groups. To direct every student studying at the University to research the subjects of activity and to support the research of students.

ğ) To establish units in accordance with the provisions of the relevant legislation in order to realize the objectives of the center; to establish or have established an archive, database, website, consultancy center that facilitates and accelerates the work of the center related to the activities of the center.

 

h) To provide consultancy, expert-advocacy and legal support services to public institutions and organizations and private law persons in accordance with the relevant legislation.

ı) To carry out other activities in accordance with the objectives of the Center.

 

 

 

PART THREE

Governing Bodies and Duties of the Center

Governing bodies of the Center

 

ARTICLE 7 - (1) The governing bodies of the Center are as follows:

 

a) Director,

b) Board of Directors,

c) Advisory Board.

Director

 

ARTICLE 8 - (1) The Director is appointed by the Rector from among the faculty members of the Faculty of Law of the University for a maximum period of three years. The Director, whose term of office is completed, may be reappointed and dismissed by the same procedure.

 

(2) In cases where the Director is absent from his/her duty for more than six months for any reason, his/her duty ends. A new Director is appointed in the same manner to replace the Director whose duty has expired.

 

(3) One person among the faculty members of the Faculty of Law of the University is appointed as the Deputy Director upon the recommendation of the Director and the approval of the Rector. The term of office of the Deputy Director is limited to the term of office of the Director. The Deputy Director, whose term of office expires, may be reappointed in the same manner. When the Director is not on duty, his/her deputy deputizes the Director.

 

Duties of the Director

 

ARTICLE 9- (1) The duties of the Director are as follows:

 

a) To manage and represent the Center.

b) To ensure that the Center and its affiliated units work regularly and effectively in line with the objectives set out in this Regulation.

c) To set goals for the development of the Center.

ç) To set the agenda of the Board of Directors and Advisory Board, to call the members to a meeting, to chair the Board of Directors and to implement the decisions taken by the Board of Directors.

 

d) e) To prepare the annual activity report with the work, goals and plans of the Center and submit it to the Rectorate after receiving the opinion of the Board of Directors.

e) To prepare the annual work program for the following year and submit it to the Rectorate after receiving the opinion of the Board of Directors.

f) To inform the Board of Directors about the work carried out.

g) To carry out relations with national and international organizations regarding the research, projects, education-training and other activities of the Center.

ğ) h) To determine all kinds of academic, administrative, technical and other personnel needs required to carry out the activities of the Center, to make a proposal to the Rectorate for assignments, to establish working units, working and project groups.

 

h) To establish working units, working and project groups in line with the research, project, training and similar activities of the Center. To submit to the Rector the need for a sufficient number of personnel to be employed in the created units and to ensure their assignment.

ı) To carry out other duties in accordance with the purpose of the Center.

 

Board of Directors

 

ARTICLE 10 - (1) The Board of Directors consists of five members in total, including the Deputy Director under the chairmanship of the Director, and three members appointed by the Rector for three years from among the faculty members of the Faculty of Law related to the fields of study of the Center.

 

(2) The term of office of the members of the Board of Directors is three years. A member whose term of office expires may be reappointed. In case the membership of the Board of Directors becomes vacant for any reason, a new member may be appointed to complete the remaining term.

 

(3) The Board of Directors convenes at least once every six months upon the invitation of the Director and decisions are taken with the absolute majority of the participants. In case of equality of votes, the majority in favor of the Director's vote shall be deemed to have been achieved. Participation in the meetings can also be made via video conferencing or the internet.

 

Duties of the Board of Directors

 

ARTICLE 11 - (1) The duties of the Board of Directors are as follows:

 

a) To take decisions on issues related to the work and management of the Center.

b) To discuss and decide on the annual activity report and annual work program of the Center.

 

c) To take decisions on issues related to research, education-training, application, consultancy, publication and other fields of study.

ç) To plan in-service training programs for the personnel working at the Center.

 

d) To establish the units and working and project groups to be established within the Center, and to determine their working procedures and principles.

e) To prepare investment plans and programs of the Center.

f) To determine the pricing and payment procedures for the services to be provided for a fee at the Center and submit them to the Rector.

g) To determine the principles and procedures of the studies to be carried out jointly with public and private institutions in Turkey and abroad.

ğ) To take decisions on other issues brought up by the Director.

 

Advisory board and its duties

 

ARTICLE 12 - 1) The Advisory Board consists of a maximum of ten people appointed by the Rector from among the experienced people from within or outside the University on the subjects related to the field of activity of the Center upon the recommendation of the Board of Directors.  The term of office is three years. Members whose term expires may be reappointed.

 

(2) The Advisory Board evaluates the activities of the Center and reports its opinions and suggestions on new studies to the Board of Directors.

 

(3) The Advisory Board convenes regularly once a year. The Director may call the Advisory Board for a meeting if deemed necessary. An absolute majority is not required at the Advisory Board meetings. Participation in the meetings can also be made over the internet via video conferencing and similar methods.

 

SECTION FOUR

Miscellaneous and Final Provisions

Staffing needs

 

ARTICLE 13 - (1) The academic, administrative and technical personnel needs of the Center are met by the personnel to be assigned by the Rector according to Article 13 of Law No. 2547.

 

Working groups

 

ARTICLE 14- (1) When necessary, upon the proposal of the Director and the decision of the Board of Directors, working groups or project groups may be established with the units of the Center in order to divide work on issues within the field of study of the Center.

 

Fixtures and equipment

 

ARTICLE 15 - (1) All kinds of tools, equipment and fixtures purchased within the scope of the activities of the Center shall be allocated for the use of the Center.

 

Expenditure authority

 

ARTICLE 16 - (1) The Rector is the expenditure authority of the Center. The Rector may delegate this authority to the Director if deemed appropriate.

 

Cases where there is no provision

 

ARTICLE 18 - (1) In cases where there are no provisions in this Regulation, the provisions of the relevant legislation and the decisions of the Senate are applied.

 

Effectiveness

 

ARTICLE 19 - (1) This Regulation enters into force on the date of its publication.

 

Execution

 

ARTICLE 20 - (1) The provisions of this Regulation are executed by the Rector of Ibn Haldun University.
